All parties wishing to conduct business at ADE agree to these Terms of Sale.

Transaction Processing

All transactions must be processed through the A.D.E. office. Unauthorized sales conducted on the premises without office clearance may result in termination of business privileges.

Dealer Registration

Dealers attending for the first time must register at the office prior to any buying or selling activity.

Salvage Titles

Any vehicle with prior or salvage title status, whether a theft being recovered or rebuilt collision vehicles must be announced at the time of sale. Any unannounced salvaged vehicles are the complete responsibility of the seller at the time of discovery within 30 days of the sale.

Title Mailing Disclaimer

A.D.E. is not responsible for titles lost in the mail or through courier services. Duplicate title services can be provided upon request.

"Ride and Drive" Guarantee

Vehicles sold with a "Ride and Drive" designation are guaranteed by the seller to be mechanically sound, allowing for up to $800 in minor mechanical repairs.

Air-bag Announcement

Airbag Lights and/or missing airbag components must be announced.

"Auction Guarantee" Terms

Vehicles sold under "Auction Guarantee" covers powertrain components only (engine block, rods, crankshaft, transmission, transfer case, and front differential). Air conditioning and wear items are excluded from this guarantee.

Storage Fees

A.D.E. may set limits for the removal of customers’ Vehicles and may charge storage fees of $25 per day for each vehicle not removed in a timely manner. Applicable dealer agrees that A.D.E. (1) shall acquire a lien on any vehicle for unpaid storage, as provided by law, (2) may refuse to release any vehicle while fees are unpaid, and (3) may be authorized to resell the Vehicle to recover storage fees, as provided by law.

Legal Liability

All buyers and sellers agree to hold A.D.E. harmless from any and all litigation resulting from transactions conducted at A.D.E.

Frame Damage & Flood Vehicles

Any vehicle with frame damage, frame repair, or flood history must be announced at the time of sale. Failure to disclose such conditions will render the seller is fully responsible for any issues discovered within 14 days of the sale.

Arbitration Timeframe

Dealers have one (1) hour from the time of purchase to either complete payment or initiate arbitration. All complaints and rejections must be processed through arbitration within this one-hour window.Unjustified rejections will not be tolerated. Management decisions are final in all arbitration matters.

Odometer Statements

A.D.E. assumes no responsibility for odometer readings or odometer statements. It is solely the responsibility of both the buyer and the seller to secure accurate odometer statements at the time of sale or purchase.

Supersession of Previous Policies

All prior A.D.E. policies and pre-printed forms issued before June 1, 2025, are null and void.

Payments

Payment is expected on the day of the sale or when a transferable title is available. A.D.E. offers a grace period of 48 hours. If payment is not received by this time, a late fee of $100 will be added to the purchase price of the unit.

Visible Defects & Glass Damage

Visible defects, including broken or cracked glass, are not eligible for arbitration.

Specialty Vehicles

A.D.E. does not guarantee the year, odometer, hour meter, or condition of recreational vehicles, boats, motorcycles, dune buggies, or similar specialty vehicles. All specialty units are regarded by ADE as being sold in 'as-is' condition. Any guarantees are the seller’s responsibility.

For Money Owed to A.D.E.

Money owed to A.D.E. (bad checks, repurchase of vehicles), both the seller and buyer allow A.D.E. the right of o set at your bank on checks given by A.D.E. The buyer and seller both agree to hold A.D.E. harmless from any and all litigation that may arise from transactions at A.D.E.

Title Attached ("T/A") Sales

Sellers must announce any “Title Attached” (T/A) vehicles at the time of sale and must deliver a re-assignable title to A.D.E. within 31 days.

If the title is not received within 31 days, the buyer may return the vehicle.
Buyers are advised not to spend money on or resell T/A vehicles until the title is received.
A.D.E. is not liable for any costs associated with returned T/A vehicles.
Mileage parameters for a late title return: 250 miles max, then a $1/mile will be deducted off the original sale price.

Gate Pass Requirement

All vehicles must have a valid gate pass to exit the A.D.E. premises.

Vehicle Pricing & Arbitration

Vehicles sold for $2500 or less are sold strictly "AS IS" and are not subject to arbitration. Vehicles with a model year of 10 years and older or exceeding 130k miles DO NOT qualify for PSI.

Announcements & Red-Light Indicator

If the red light is illuminated, it indicates that there is an announcement regarding the vehicle. Buyers are responsible for understanding all announcements before placing a bid.

Commercial Vehicle Disclosure

Taxis and commercial vehicles (e.g., police, municipal vehicles) must be announced at the time of sale. Failure to do so places full responsibility on the seller upon discovery.
